Nuskha Terms of Use (End User Licence Agreement)
DRAFT for review by a lawyer. Not final. Version 1, October 2026.
These terms are between you (the doctor or clinic using Nuskha) and Nuskha, run by Pratham Arun Hadap, a sole proprietor in Maharashtra, India ("Nuskha", "we", "us"). By clicking "I agree" or by using Nuskha, you accept these terms. If you do not agree, do not use Nuskha.
1. What Nuskha is
Nuskha is desktop software for doctors. It helps you keep patient records, write prescriptions, print or send a daily medicine plan to the patient, and keep track of follow-up visits. It is a record-keeping and documentation tool. It does not diagnose, suggest treatment, choose medicines or doses, or check prescriptions for safety. See the Medical disclaimer.
2. Who may use it
Nuskha is for registered medical practitioners in India and their clinic staff working under them. You confirm that you are allowed to practise and to keep medical records.
3. Your licence
We give you a non-exclusive, non-transferable licence to install and use Nuskha on the computers of your clinic, for the period of your trial or paid licence. One licence key is for one clinic and may be used on any number of that clinic's computers. You may not:
- sell, rent, share or give your licence key to another clinic;
- copy, change, decompile or reverse-engineer Nuskha, except where the law allows it;
- remove notices about Nuskha or the open-source software inside it;
- use Nuskha for anything unlawful.
Nuskha contains open-source software under its own licences, listed in THIRD_PARTY_NOTICES.
4. Trial, payment and renewal
- A new installation has a free trial of 30 days.
- After the trial you need a paid licence: currently ₹999 for 1 month or ₹9,999 for 1 year, paid by UPI or another method we offer. Prices may change; a change does not affect a period you have already paid for.
- You receive a licence key after we confirm your payment. A licence does not renew by itself.
- When a trial or licence ends, Nuskha keeps working for 7 more days. After that it becomes read-only: you can still open, search, print, export and back up all your records, but you cannot finish new prescriptions until you enter a new key. We never lock your patient data.
- Refunds: see the Refund policy.
- Prices include any taxes that apply. If GST becomes payable, we will tell you before you pay.
5. Your data and your duties
- All patient data stays on your computer. We do not receive, store or see it (see the Privacy policy).
- You are responsible for the patient data you keep in Nuskha, including getting the patient's consent, keeping records for the time the law requires, keeping your computer secure, and making backups. Nuskha offers encrypted backups and a PIN lock; please use them.
- You are responsible for everything written on a prescription or plan made with Nuskha, and for checking it before giving it to a patient.
- If you lose your computer, your backup password or your backups, we cannot recover your data.
6. Updates and support
Nuskha checks for and installs updates. Support is offered by WhatsApp and email on working days, on a best-effort basis. We may change or stop features, but we will not take away your ability to read and export your own data.
7. No warranty
Nuskha is provided "as is". We work hard to make it correct and reliable, but we do not promise that it is free of errors or that it will always be available. Always check prescriptions and plans before you give them to a patient.
8. Limit of liability
To the extent the law allows, we are not liable for indirect or consequential loss, loss of data, loss of income, or any harm from medical decisions. Our total liability for any claim is limited to the amount you paid us for Nuskha in the 12 months before the claim.
9. Ending this agreement
You may stop using Nuskha at any time and uninstall it; your data stays on your computer. We may end your licence if you break these terms (for example by sharing your key with another clinic). These sections continue after the agreement ends: 5, 7, 8, 10.
10. Law and disputes
These terms are governed by the laws of India. Disputes will first be discussed in good faith. If not resolved, the courts at [CITY], Maharashtra will have jurisdiction.
11. Changes and transfer
We may update these terms. If a change is important, Nuskha will show the new terms and ask you to agree again. We may transfer this agreement to a company or person who takes over Nuskha; your rights under it stay the same.
